If you enjoyed (or were angered by) the Yoo terror memos that I linked to last week, you might be interested in knowing that we can give partial credit for their release to a Northern District judge. Judge Jeffrey White, who is presiding over the Jose Padilla case, issued an order for the memos to be released publicly just three days before the Justice Department gave them up to the Internet. In his suit, Padilla accuses Yoo of violating his constitutional rights by writing the legal opinions that legitimized torture of enemy combatants. Padilla was imprisoned in 2002.
You can read more about Padilla's case against Yoo here (free reg. req.).
The DoJ has since decided to defend Yoo in the civil case. I can just imagine Eric Holder telling Yoo, who is now visiting Chapman, to please be a little more polished next time.
Quite impressive actually. It lasted for a while but worthy on the end.
