The Christian Legal Society of Hastings suffered an apparent setback in its litigation against Hastings yesterday.
The student group, which is suing Hastings for denying the group use of school funds because the group excluded gays and non-Christians, has been met by a big foe: circuit precedent. In Truth v. Kent School District the Ninth Circuit set a standard for schools, allowing them to refuse to hand over school money to groups whose exclusionary rules violate schools' policies of nondiscrimination.
The Alliance Defense Fund is expected to file a cert petition in the Truth case at the Supreme Court. The outcome of Truth may determine the outcome of the Hastings group's fate, as well.
